Dear Friends,  

Congratulations on your success!  Yesterday, President Obama signed legislation that designated the portion of Piru Creek downstream from Pyramid Dam to the Ventura County line as a federally-protected Wild and Scenic River.  The Piru Creek protection was one small part of a major land and water protection bill that designated wilderness and protected rivers as wild and scenic in many states.  Senator Barbara Boxer and Representative Buck McKeon championed the protection of Piru Creek.  The portion remaining downstream of the Ventura County line is within the congressional district of Rep. Elton Gallegly and was not protected by this bill.  

The provisions that protected the portions of Piru Creek are excerpted below:


199 (a) PIRU CREEK, CALIFORNIA- The following segments of Piru Creek in the State of California, to be administered by the Secretary of Agriculture:

(A) The 3-mile segment of Piru Creek from 0.5 miles downstream of Pyramid Dam at the first bridge crossing to the boundary of the Sespe Wilderness, as a recreational river.

(B) The 4.25-mile segment from the boundary of the Sespe Wilderness to the boundary between Los Angeles and Ventura Counties, as a wild river.'

(b) Effect- The designation of Piru Creek under subsection (a) shall not affect valid rights in existence on the date of enactment of this Act.

Nothing in this designation directly addresses the yet-to-be-approved plans of the California Department of Water Resources to eliminate the summertime flow of water downstream of Pyramid Dam and the impact of that on recreational uses of the river, especially trout fishing.  However, designation of the river as a wild & scenic river requires Federal and State agencies to protect the free-flowing character of the river and the values (fish, wildlife and recreation) for which Congress and the President sought the designation.  

In addition, the U.S. Forest Service is required to write a comprehensive management plan for the river and the protection of those values.  Hopefully, we will never again be told, as we were a few years ago, by an federal agency official that Piru Creek was no longer a river but simply a canal or waterway for irrigation water.  The Forest Service and the Federal Energy Regulatory Commission now have the strongest federal river protection tool in their hands.

Something is better than nothing. Glad it passed just hope that it goes good and is not one of those deals where both sides get what they want and in the end we the public get less of what we had.  LEW
